Katie Holmes files for divorce from Tom Cruise

None of Cruise's exes ever talk about him. Not Mimi Rogers, not Nicole Kidman, not even the women who date him. It's like he's got their pets and grandparents held hostage somewhere.

Mimi Rogers did talk at first and then it seemed as if she got blacklisted but probably not. I specifically recall that she said she wanted to have a baby and TC wasn't interested in doing what it takes. I drew my own conclusions but who knows what she really meant.

Her dad helped her file the divorce papers but it was her decision.

Something tells me Katie's dad had those papers prepared and waiting for her signature a LONG time ago. ;)

On July 3, Katie filed an aggressive legal action — an ‘emergent application’ – in New York City court to determine immediate custody and child support issues over Suri Cruise. There is already a court date that Tom will have to attend! Only HollywoodLife.com has all of the EXCLUSIVE details!

Katie Holmes has just taken a very aggressive step in her divorce from Tom Cruise: she has requested an ‘emergent application’ to make the trial public in the New York City court system!

Katie, 33, has taken a huge step in batting Tom, 50, a source close to the situation tells HollywoodLife.com EXCLUSIVELY.

“Katie filed an ‘emergent application’ in New York City on July 3,” our source tells us. “It’s a motion seeking temporary emergency relief, which can include child support and custody. It also means that Tom is going to have to hire a New York lawyer — he can’t use his Calif. lawyer anymore. The motion also means that both Tom and Katie have to be present in court on July 17. A judge is now assigned to their case, which means it’s no longer going to be an out-of-court settlement. They are scheduled to appear before Judge Matthew Cooper on July 17 at 9:30 AM.”

Our source also said this filing sends a very clear message to Tom.

“Katie doesn’t anticipate Tom cooperating, and there have been rumors that he’s going to file in Calif. and argue that litigation should be there rather than New York. Bottom line: if you file an emergency motion, you don’t believe there’s going to be cooperation from the other party or you need an order that only the court can give. It might have something to do with trying to control the media. They filed under anonymous verses anonymous to avoid the media. Most celebs do that.

“It’s unlikely for a celebrity to file an emergency hearing, because most celebrities settle out of court because they don’t want the media involved in their case. Katie and Tom are now going to have an open court room, which means that anyone can walk in and see what’s happening. Plus, they are putting their case in the hands of a judge who is going to determine what happens next. Most public figures don’t want that — it’s a last resort. It’s super-aggressive for Katie to have taken these steps. It suggests that there’s going to be a contentious divorce battle to come.”

HollywoodLife.com also spoke EXCLUSIVELY with celebrity divorce attorney Vikki Ziegler, author of The Pre-Marital Planner, who told us what Katie is hoping to gain from this move.

“Tom is probably asking for parenting time,” she said. “She’s asking for it to be reviewed on an expedited basis to protect the child, Suri. She’s saying, “I want this case tried in New York, I want temporary full custody, I want child support and I may want my legal bills paid as well.”

HollywoodLife.com reached out to reps for both Tom and Katie, but we haven’t yet received a comment.

Do YOU think all of Tom’s Scientology secrets will be exposed, HollywoodLifers?

I will be the first to admit that my gaydar is awful, but why do so many suspect Tom Cruise is gay? What "proof" is there?

Yes, I am being hypocritical because in the Anderson Cooper thread I said it was disgusting and very nosy for others to speculate on one's sexuality. In Cruise's case, however, I don't feel bad for him since he is so quick to condemn others.

Wow. Who knew little Joey Potter could be this calculating?

Wow, that's freakin' awesome. I love that. Make it public so all the dirty Scientology details can be revealed, just as Tom wouldn't want. She and daddy Holmes clearly thought this all out in advance. Brava!

I have been reading comments from other CoSs members and they seem to really have turned a blind eye to every single thing that happens to one of its members, so much so that they are defending the "church" more than Cruise of anyone of the other celebrities involved. Kirstie Alley made a smart Twitter remark about how people think they know what happened but don't know a thing. And Leah Remini, who I still love as a actress and for her charity work, seems to get personally offended if anyone says anything the slightest bit negative about that thing.

Look, I can't stand TC. Really. He always comes off so smug and arrogant. And he and Mel Gibson have a lot in common...they're both nuts. But since, unlike a few in this forum, I don't have one clue what Katie was thinking about when she married this slime, I'm on her side in this whole thing until i hear something different. And, there are some who have acted like they never did anything really stupid in the name of love. Or what they thought was love. Glass Houses sounds like it has been forgotten where she is concerned.

That whole thing sounds like Jonestown to me. I just feel we'll hear something about a group of them committing mass suicide down the road. That whole thing sounds very dangerous, and I pray for anyone involved with those people.

Despite all this legal maneuvering, I can't see how Katie Holmes ends up with sole custody. Maybe she has dirt on Cruise, but if she had enough, there would have been no need for her to go all the way to New York to file for the divorce.

I can't help wondering what Holmes thought as she watched Cruise's two children estranged from their mother. It never occurred to her that this could happen to her before she had a child with him? Unbelievable.

Katie Holmes is clearly going balls to the wall with an emergent application. The thing is, she can withdraw that application and make an out of court settlement. What she's angling for is for Tom Cruise to crack. If I was his lawyer, I'd be telling him to consider her demands seriously because it seems she has got some very clear information that could mess him up.

All of a sudden, this is turning into some primetime soap; and although I feel sorry for how Suri is mixed up in all this, OTOH, I'm simply riveted by how these events will turn out.

My gaydar is...decent. I think I can claim about an 80% accuracy rate. But yeah, I don't get "gay" from Tom Cruise either. I think he's crazy and I have no doubt he's hiding something but I don't get the feeling it's his sexual orientation. I get the feeling he's hiding something sinister and awful that makes him lash out at other people. He strikes me as someone who was horribly abused or something and still hasn't come to terms with it so he deflects and controls.
