Despite that other chart’s refusal to recognize the Eagles’ sales feat this week, HITS has decided that the band’s Long Road Out of Eden album should be #1 on our Top 50, easily outdistancing Britney Spears’ Jive/ZLG effort Blackout.

According to Wal-Mart, the band’s first all-new studio album since 1979’s The Long Run sold 707,253 copies exclusively at the retailer’s outlets nationwide.

Britney’s new album is one of six newcomers to the Top 10, with a total of 290k, good for #2.

SCAN FOLLOWS SUIT: No sooner did we announce that the Eagles would be #1 on HITS' Building Album Sales chart this week than that other trade magazine has come out with the news that, despite the fact Long Road Out of Eden is available exclusively at Wal-Mart and the band's website, it will be #1 on theirs as well.

The move is already being enthusiastically embraced by our reader, one Jill Fouts of cbgla.com, who writes: "I have to give you guys kudos for embracing reality and putting the Eagles at the top of your chart!" Of course, that's about the only reality we've embraced over the past 21 years. (11/6p)

Actually, no, that album will be counted as double when its certified by the RIAA. Sound-scan will only count the album as a single unit, and in just one retailer, it scanned over 700,000 copies. Though, even if its sales were halved, it would still be enough to be the #1 album.

Selling over 700,000 copies was just too much to ignore. Let's not forget The Eagles also have the best selling album in the history of the US - The Eagles Greatest Hits.

I doubt Billboard is going to count it. Garth Brooks sold over 500k of his album exclusive to Walmart as well and Billboard didn't count it and gave it to System Of Down which sold 320k that same week. Britney will be no.1 and her record will be untarnished.

More then likely Spears will have the BBHot200 no.1 album and the Eagles will be no.1 on the Comprehension chart

LOS ANGELES (Reuters) - In an unusual duel at the top of the U.S. pop music charts, both veteran rock band the Eagles and tarnished pop princess Britney Spears can claim that they have the No. 1 albums this week.

The Eagles released "Long Road Out of Eden" -- their first studio album in 28 years -- exclusively through Wal-Mart Stores Inc. last week, and it sold more than 700,000 copies, the retailer said on Tuesday.

The only problem is that Wal-Mart does not report sales to SoundScan, a tracking service whose retail data are used to formulate Billboard magazine's weekly Top 200 albums chart, which is the industry benchmark.

That will allow Spears to take the top spot when SoundScan data are issued on Wednesday. "Blackout," her first album in four years, sold between 330,000 and 350,000 copies during its first six days, her Jive Records label has estimated.

A similar situation occurred almost two years ago when Wal-Mart teamed up with retired country star Garth Brooks to sell an exclusive boxed set. "Garth Brooks: The Limited Series" sold more than 500,000 copies on its first day during the busy Thanksgiving holiday period, the retailer said at the time. The claim was met with some skepticism by music industry insiders who said the actual figure was probably in the 300,000 to 400,000 range for its first three days.

When SoundScan data were issued the following week, it showed that Los Angeles rock band System of a Down was the No. 1 act with sales of 320,000 copies during the first six days of release for its album "Hypnotize."

EAGLES SOAR

Exclusive releases have become common in recent years, with retailers such as Target Corp. and Starbucks Corp. aggressively striking deals with musical acts in order to drive customer traffic. Billboard excludes exclusive releases from most of its charts, but does allow retailers to report sales to its "comprehensive" albums chart, which includes sales for catalog releases, meaning albums that are generally more than two years old.

With reported sales of more than 700,000 copies for their album, the Eagles have become one of the biggest-selling acts during another dismal year for the music industry. Overall sales so far in 2007 are off about 15 percent from the year-ago period. The biggest SoundScan seller of 2007 is rapper Kanye West, whose "Graduation" sold 957,000 copies during its first six days in September.

For Spears, whose musical career has been overshadowed in recent years by an unending litany of personal and professional missteps, the prognosis for "Blackout" is less certain. Her previous release, "In the Zone," debuted at No. 1 in November 2003 with 609,000 copies. It went on to sell relatively poorly compared to her previous releases.

Spears has released just one single from the album, "Gimme More," which peaked surprisingly strongly at No. 3 on Billboard's Hot 100 singles chart.

Jive has not announced plans for a follow-up, and Spears has done little to promote the album, apart from a widely ridiculed performance at the MTV Video Music Awards in September.

Jive is a unit of Sony BMG Music Entertainment, a joint venture between Sony Corp. and Bertelsmann AG. The Eagles own their own label.

If Wal-Mart chooses to report sales of its exclusive Eagles album, the veteran band could surpass Britney Spears next week on Billboard's Top Comprehensive Albums, according to Eagles manager Irving Azoff.

Spears' "Blackout," her first studio album since 2003, led Nielsen SoundScan's Building Chart with 124,000 sold when the chart was released earlier today (Oct. 31). The Eagles' "Long Road Out of Eden" was missing from that list, which suggests Wal-Mart will choose not to report sales from the title, as was the case with exclusive Garth Brooks albums it sold in prior years.

"If the Eagles were SoundScanning this week, even though it's only available at one retailer, Britney wouldn't be No. 1" on the Building Chart, said Azoff, speaking by phone Wednesday from London, where the Eagles played a showcase for media and Universal Music Group honchos at Indigo2 Club.

Titles that are not generally available at retail are not eligible to appear on The Billboard 200, but are entitled to chart on Billboard's Top Comprehensive Albums, which includes catalog titles and proprietary albums from retailers willing to report those sales.

Best Buy, Starbucks and iTunes are the accounts that have been most willing for their exclusive titles appear on Top Comprehensive Albums and Top Comprehensive Music Videos, but most other chains have withheld charting their proprietary offerings.

Target had been among those holdouts, but did elect to allow Collective Soul's recent "Afterwords," sold only at Target stores and by iTunes to chart. It peaked at No. 25 on Top Comprehensive Albums.

Wal-Mart has until the end of the tracking week to decide whether it wishes to report sales of the Eagles album. A Wal-Mart source told ABC News Radio that "Eden" posted the best first-day total "by far" for that chain, which includes Sam's Club stores. The source did not reveal that total, but said it exceeded projections by 50%.

Aside from two compilations, "Eden" is the Eagles' first album since the live "Hell Freezes Over," which led The Billboard 200 for two weeks in 1994.

Like I said, the album isn't eligable since it's isn't a "wide release". As said above it could chart on the catalogue chart but not the 200. If they did they would have to chart all the other releases that were not wide releases.

^That's an article from a week, ago, I expect since Sound-Scan will be counting The Eagles album, it will reflect on Billboard tomorrow. We'll just have to wait and see, when Billboard releases its total album chart. Hits wouldn't report that Sound Scan will be incorporating The Eagles album, if it weren't true.

They could be using that information for the catalogue chart, not necessairly for BB 200.

We'll see tommorow, I see no reason why BB would change thier criteria now especially since it's going to be even more of a hassel then before to add in the limited releases to the wide releases. There are two charts for a reason. This isn't the first time this has happened. I don't understand why they would change it.

Revised Chart Policy Lands Eagles At No. 1

The Eagles' first new studio album in 28 years, "Long Road Out of Eden," takes a short route to No. 1 on The Billboard 200 after Billboard revised a significant chart policy today (Nov. 7).

In consultation with Nielsen SoundScan, Billboard will now allow exclusive album titles that are only available through one retailer to appear on The Billboard 200 and other charts, effective with this week's charts. Prior to this, proprietary titles were not eligible to appear on most Billboard charts.

Early SoundScan numbers have the Eagles taking the top perch on The Billboard 200 with 711,000 copies sold, with most sales moved by Wal-Mart and Sam's Club stores. For now, the only other U.S. outlets carrying "Eden" are walmart.com, where both physical copies and downloads are sold, and the Eagles' own Web site.

"Eden" became available at the mass-market chain Oct. 30. Aside from two compilations, this is the Eagles' first album since the mostly live "Hell Freezes Over," which led The Billboard 200 for two weeks in 1994.

Britney Spears' new Jive album, "Blackout," which would have been No. 1 had the Eagles' data not been reported, will open at No. 2 with first-week sales of 290,000 copies.

"We know that some retailers will be uncomfortable with this policy, but it was inevitable that Billboard's charts would ultimately widen the parameters of to reflect changes that are unfolding in music distribution," says Geoff Mayfield, Billboard's director of charts. "We would have preferred to make this decision earlier, but only became aware within the last 24 hours that Wal-Mart would be willing to share the data for this title with Nielsen SoundScan."

The revised policy initially impacts The Billboard 200 and Top Country Albums, where "Eden" will also bow at No. 1. Criteria for the remainder of Billboard's albums charts will be formulated later this week. A handful of other titles will debut this week on The Billboard 200 as a consequence of the policy revision.

Previously, titles that were not generally available at retail were not eligible to appear on The Billboard 200, but were entitled to chart on Billboard's Top Comprehensive Albums, which includes catalog titles and proprietary albums from retailers willing to report those sales.

The comprehensive chart will continue to appear on Billboard.biz, to show how catalog titles compete with the overall market. However, once parameters for the remainder of the album charts are determined, Top Comprehensive Music Videos will be discontinued, as exclusive titles will then be eligible for the Nielsen SoundScan-fed Top Music Videos.

Wow, nothing goes right for this girl. 2007 has been a horriable year for her.

I figured with Sound Scan tracking Wal-Mart's distribution of The Eagles album, it would've had to debut at #1 on the main chart. I mean, selling over 700,000 copies is TOO MUCH TO IGNORE. It also looks like Britney sold less than expected, some were expecting 350,000-400,000 for her, yet she had to settle for a little over 290,000, which is respectable.

That's all kinds of wrong. They should have given notice to all the record labels previous to the change. You don't change the rules in the middle of the game. Jive released the album with the belief that the Eagles wouldn't be counted (and they shouldn't have been) for them to change the rules after the week is over, is beyond wrong.

I guess the fact that The Eagles broke all sorts of records put pressure on Billboard to change their rules. It's pretty hard to sweep an album that sells over 700,000 copies its first week under the rug. I could only imagine the type of backlash they would've gotten had The Eagles not debuted at #1.

BTW, this isn't the first time Billboard's abruptly changed their rules, they do have a history of doing this on their various charts.

It's just wrong that it's all about politics. If they wanted to change the rule, they should have either done it MONTHS in advance or they should have made the rule AFTER this week. You don't change the rules for the game after the game is over. I call foul! lol. But seriously they really should have done this better.
