261. (a) Rape is an act of sexual intercourse accomplished under any of the following circumstances:

(1) If a person who is not the spouse of the person committing the act is incapable, because of a mental disorder or developmental or physical disability, of giving legal consent, and this is known or reasonably should be known to the person committing the act.  Notwithstanding the existence of a conservatorship pursuant to the provisions of the Lanterman-Petris-Short Act (Part 1 (commencing with Section 5000) of Division 5 of the Welfare and Institutions Code), the prosecuting attorney shall prove, as an element of the crime, that a mental disorder or developmental or physical disability rendered the alleged victim incapable of giving consent.

  • This paragraph does not preclude the prosecution of a spouse committing the act from being prosecuted under any other paragraph of this subdivision or any other law.


(2) If it is accomplished against a person’s will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the person or another.

(3) If a person is prevented from resisting by an intoxicating or anesthetic substance, or a controlled substance, and this condition was known, or reasonably should have been known by the accused.

(4) If a person is at the time unconscious of the nature of the act, and this is known to the accused. As used in this paragraph, “unconscious of the nature of the act” means incapable of resisting because the victim meets any one of the following conditions:

  • (A) Was unconscious or asleep.
  • (B) Was not aware, knowing, perceiving, or cognizant that the act occurred.
  • (C) Was not aware, knowing, perceiving, or cognizant of the essential characteristics of the act due to the perpetrator’s fraud in fact.
  • (D) Was not aware, knowing, perceiving, or cognizant of the essential characteristics of the act due to the perpetrator’s fraudulent representation that the sexual penetration served a professional purpose when it served no professional purpose.

(5) If a person submits under the belief that the person committing the act is someone known to the victim other than the accused, and this belief is induced by artifice, pretense, or concealment practiced by the accused, with intent to induce the belief.

(6) If the act is accomplished against the victim’s will by threatening to retaliate in the future against the victim or any other person, and there is a reasonable possibility that the perpetrator will execute the threat. As used in this paragraph, “threatening to retaliate” means a threat to kidnap or falsely imprison, or to inflict extreme pain, serious bodily injury, or death.

(7) If the act is accomplished against the victim’s will by threatening to use the authority of a public official to incarcerate, arrest, or deport the victim or another, and the victim has a reasonable belief that the perpetrator is a public official. As used in this paragraph, “public official” means a person employed by a governmental agency who has the authority, as part of that position, to incarcerate, arrest, or deport another. The perpetrator does not actually have to be a public official.

Well, they are back, back. Le sigh. I was happy to see Brooke, Ridge, and (especially Nick) back. I love that Nick is not giving up yet. JW can stay as long as he wants if it gets Brooke to open her eyes. And I enjoyed her dressing Ridge down.

 

What I did not like is how fast this Luna storyline is going. Li and Sheila are trying to help her walk. She is moving about. They are moving this story too fast. She could have slowly recovered, her obsession with Will just growing, and the grandmas picking up on it and having a moral issue.

 

INSTEAD...it looks like this week is going to be triggering when I start to watch it. 

 

Bill and Grace nowhere in sight.

Yep Will consented to sex with Electra not Luna. and Sheila did the same thing to Scott Grainger, no wonder that sick b*tch was laughing along with Luna

 

Sucks that for Crew's first onscreen "Love scene"(yes I know it wasn't that) that it's a rape scene. Poor guy

That final scene on Friday with Will was...something. I mean, YIKES. Crew Morrow should have tried that again.

It would have been great if they could have gotten at least one new restaurant or coffeehouse set. Having Deacon's be the ONLY place in LA to eat has gotten old.

There's rumor that the Bikini Bar is returning, but I agree -- they need a decent restaurant. Making Deacon's pizza dump bigger doesn't exactly cut it.

Personally, I think they need to bring back the Forrester Creations employee gym. It was a great excuse to have the men shirtless. If the stories are going to be horrible, they can at least give us eye candy.

My interest for B&B has gone downhill in the last few years (since the covid but this last year and a half was particularly horrendous). There are  only a few things I look forward to and desperately want right now. 

Spoiler

1) Thomas/MA return next month. Hopefully the writers get it right with Thomas and Hope. His departure left a huge hole last summer, and it's really been the only pairing worth rooting for in the last 5 years for me. Only time I supported Hope too. They had the strongest chemistry and the most realistic slowburn love story. 

2) New love interest for Liam. The actor is gold and after 15 years he deserves his own love. Don't even think about revisiting Steam or Lope again, specially after this near death experience he just went through. I can go from liking Liam to loathing him fast. Either free SC from B&B for good or write a new love story for him. 

3) End the triangle from hell once and for all. Are there even fans still rooting for Bridge or Tridge? I don't see them if they exist. The writers took Ridge's waffling too far. Let Brooke be with Bill Nick or Deacon, and give Taylor her own love interest. Ridge needs to be dumped and alone for a while. I like TK but Ridge needs to suffer.

4) Finn/Luna/Sheila/Steffy... I'm praying for a new direction when JMW returns from maternity leave and Finn learns his daughter is alive (and likely pregnant). I used to be okay with Sinn but now they're such a bore. They're no supercouple. 4 years of the same stories, yawn. Steffy deserves some peace and Sheila/Luna free stories. I think Finn needs to be with sb else too.

I hope they keep newcomers like Remy and Daphne and bring a few more new characters now that they've new sets, and bring back old ones. Bell said there would be more fashion soon, I hope he wasn't teasing.

This 1000%. Ridge has become so un-rootable with his waffling between Brooke and Taylor. It's also made both women look like doormats with zero self-esteem. I'm a long-time Brooke and KKL fan, but the constant throwing herself at Ridge the past few years has made her just look like a sad sack.

Ridge is not Brooke's "destiny." He's the toxic albatross around her neck.

I've been watching season 1 on Tubi which I never saw as a teen back in the day. The writing is downright AMAZING compared to what we get now, and Brooke is an intelligent woman who's just graduated from college with a degree in chemistry. Sure, she wants to climb up the social ladder, but she still has a backbone, too.

Brooke and KKL had much more chemistry with Bill and DD. Either pair them again, or...just hear me out...bring on a brand-new character without story baggage for days! How refreshing would that be.

Wow, Luna! I have to agree that was rape. 

I also have to suspend disbelief. With Will being that inebriated, I don't know how he'd be able to "perform".
