Writer's Strike Thread

Unless Hogan and team were fired directly before the strike, wouldn't it be illegal for Corday to fire the writing team during the strike, without invoking the force majeure clause? He'd be risking too much legal action there. Then again, Corday does like wasting money as if it were water...

They weren't fired before the strike.

Corday's not a good business man that's for sure. He continues to waste money.

Who said it was force majeure?

Isn't that the only way to legally axe writers during a strike?

I think that article was a bunch of bull to be honest. I can't see Hogan and his entire team back after only a week of being fired, that would be the strangest thing to happen behind the scenes on daytime in years.

Well....LEGAL is the key word. Force Majeure is suppose to be invoked when an "Act of God" happens. So if a writer was force majeured, I think the writer could fight it through the legal system because the strike isn't an "Act of God".......It's all very tricky and confusing.

And, once again, the most exciting thing on daytime is offscreen.

I'm just hoping this means Hogan and co. are back.

I will be over the moon if this is true.

Corday wouldn't be so stupid to fire them without using force majeure would he?

Ok...don't answer that. He would .

Interesting indeed and it would be strange if they got re-hired. I would love it though.

The latest from DHD: http://www.deadlinehollywooddaily.com/

SATURDAY 9:00 PM: I've received word from inside the Shrine Auditorium meeting that the WGA West membership seemed "very positive" about resolving the writers strike as soon as possible and accepting the deal negotiated by the guild leadership with the Hollywood moguls. Also, the WGA leaders wisely decided to ensure that guild members vote within the next 48 hours before the strike can be called off. A writer who just left the confab told me: "There was cheering for everything and standing ovation after standing ovation for all the leadership, especially Patric Verrone and Dave Young. There is no question in my mind that because of the atmosphere in that room this strike will be called off. There is no gearing for a fight. It's over."

WGAW President Patric Verrone announced that there would be a vote of the membership over the next 48 hours on whether or not to lift the strike. Presumably this vote will be done electronically. I'm told that Verrone said specifically that the decision to call off the strike, regardless of the WGA Negotiating Committee's or the WGAW Board's or WGAE Council's recommendation, was to be in the hands of the membership. Pending that outcome, the 10-day ballotting process for members to accept the tentative deal would begin. So Hollywood may get back to work by Wednesday.

About 25% of the attendees left the auditorium after Dave Young explained the deal points. But the meeting is still going on as members now ask questions about specific terms.

I'm sure Tom Casiello will give us all a nice blog entry soon enough, if this is true...

He did blog, but didn't mention anything about the potential re-hiring. He just talked about the strike.

What I know, and what I don’t

Current mood: optimistic

My friend's birthday was tonight. We had a lovely dinner. I came home. To a little bit of insanity.

I know there are crazy rumors flying all around the Internet right now. About the strike, about Days, about everything.

Here's what I know: NOTHING is more important than getting a solid deal that we can all get behind and support. That's all that should matter right now. EVERYONE needs to get back to work. In daytime. In primetime. Actors, Writers, Directors, Electricians, Prop Departments, Camera Departments, Hair, Make-up, Wardrobe - EVERYBODY.

Let's keep this in perspective. We are a breath away from ending this seemingly neverending battle for a fair deal. I know this, for a fact. And nothing else.

Hang in there - it's almost time to exhale...

Please, God, I hope this is true!

However, I have two worries...

One, I can't imagine Hogan wanting to come back to work for a man who just fired/tried to fire him last week. The second reason is that I feel this might be a technicality. Perhaps Corday couldn't legally fire them when they were on strike (Is that true? I thought I read that if you're on strike after so many days you can be let go?) so now they have their jobs back, but he's planning to bring the axe down again on Monday or something... this time legally.

Who knows? Eeeeee! I'm so excited though. I pray to God that this is all true and Hogan/the team are back permanently.

Doesn't this also mean that Dena Higley would have to be out? *squeals*

I think a decision of firing a writer has to be made BEFORE the strike, to be fired legally during the strike??

He did blog, but didn't mention anything about the potential re-hiring. He just talked about the strike.

Well, he mentioned all sorts of rumors flying and mentioned Days in that line too. He could've easily denied them if he had an idea there was no chance or if it wasn't likely.

I hope to God this is true. I always wondered about Higley. Fi-Core or not, how can Higley remain as HW if she has been writing during the strike. Her being Fi-Core means Days is exempt from awards (which they don't get anyway but would other writers want to be on her team considering that?) and if she isn't Fi-Core she was outed publicly by Hinsey as writing during a strike and that is not good for her. Why would even an imbecile like Corday want to deal with all that flak? The writers that have been striking won't want to work with her considering all that based on unity, especially if she has been doing it in secret like it appears she may be.

I just don't get why she would remain after the strike no matter what she is. It does more harm then good, even without mentioning the actual story she is telling.

I am just happy there is even a smidge of hope that Hogan and co are returning. I am 100% for that, no doubt. At the very least, I get the sense here we may be at least rid of Higley based on the wording of that Days tidbit. I guess the question is would Corday be stupid enough to fire them all without exercising force majere? He's not the sharpest tool in the shed so I guess it's possible .

Well, I´m not a lawyer and don´t know the writers contracts but I do think WGA will might want to make an example from the DAYS scab. I mean, no other show dared to betray the strike so openly. Other soaps may had some writers going fi-core or writing scripts secretly, but only on DAYS we had scab who forced herself into the team just before the strike, got rid off the official striking team during the strike and after the strike should be officially named as new HW.

It´s like Corday and this scab are openly laughing WGA into the face and with Sheffer, Casiello and others being huge supporters of the strike I could see WGA going long way to support them and secure their jobs back.

I see possitlby a lawsuit in KC's future. And it couldn't happen to a nicer guy. <_< Hopefully the WGA will set them straight and the DAYS writing team with Hogan will get their jobs back.

Ahhh, fun lawsuits. With the "budget crisis" at Days, I'm sure that's the last thing Corday's hoping for.
