February 3, 200917 yr Member Something I've been wondering for a while...that picture of Michael Phelps smoking marijuana or whatever has been going around. My question is are pictures/videos of people doing drugs immune from the law or are they just ignored? I'm not saying I want MP arrested by any means. But there are shows on TV that show real people using illegal drugs (worse that marijuana). Is this generally ignored by law enforcement? Lol wow, if a mod sees this, can you put drug in the title? Guess I messed that up. i could be wrong but i think they have to bust them in the act/with the drug. however pictures/videos could be used against them as evidence.

For a drug posession charge to stick, you must have it on you when arrested. The amount determines the difference between mere posession and trafficking.
